If the top isn't too small, it will lay flat. There is no clear elastic band, but it does have some give, and the fabric is not as thick as Lululemon's. I don't think it's see-through, but it's thinner and more unique than anything Lululemon has to offer. That being said, I adore them and wear them to work every day.
I'm not sure what you mean by "deal price," but I believe these pants on Amazon have free returns, so I'd buy them with confidence.
Because you cut it to fit, the height has no bearing on the size. I'm 175 pounds and ordered an XL, so if you're 160 pounds, go with a large, but double-check the hip measurements on the size chart.
The pocket on a jean is shallower than a regular pocket. I'm 5'6" and my pocket usually extends halfway down my thigh. Back pockets are also deep, but they are more in the style of a jean.
