In my memory, the elephant's legs would hang down if you picked it up because its rough texture made it very soft. Due to the fact that I gave it as a baby shower gift, I can't answer 100%.

Despite its small size, this elephant holds great appeal to my baby. It has been months since he has developed an attachment to a toy.
Under the inspiration of our 6 mo old, I pulled this stuffed animal out of the box and handed it to him. He smiled and laughed and pulled it close to himself. Aside from the softness of the fur, he enjoys playing with the other textures on the ears and feet of the toy. My first thought about how much I would appreciate it if it was stuck in a seated position was that I would not care if the legs were free to move. Having these legs free makes a huge difference to me over if it were seated. Apparently my son loves it so much, I'm going to have to get another one. My son and elephant are now centered in my arms as I rock them to sleep.

I returned it to the store. There was a poor quality to it. Not soft enough to be given as a gift to a young child. A used look could almost be seen in the texture of the "fur. " Likewise, I was concerned about the plastic eyes possibly turning into choking hazards.
