These shorts have a seamless waistband and no elastic waistband to keep them from rolling down if you carry more weight around your midsection. If you have a smaller waist and carry your weight in your hips/thighs, you should be fine; I've never had much of a waist line and found that they started to roll down after a few hours.
You'll be able to fit into a small or medium. The medium is the best option if you don't want it to be too tight.

Soooo. My wife purchased a pair of these stylish shorts and was very pleased with them. I looked for something similar in men's clothing, but nothing with two zippered pockets was available.
