Larger for a looser look, medium for a tighter fit. They're a little squishy.
I have a 38" waist as well, but ordered the 2XL for the length alone. Unless you wear them with boots and tuck the pant leg into the boot, they could have been 3" longer for me at 6'3".
If you're a size 40, you should try a different pair of pants.

Before I bought these pants, I wasn't sure if I'd like them or wear them. I had previously purchased a vest from this company and was now looking to complete my ensemble. These pants have the look and feel of skinny jeans, but they're more versatile and comfortable. br>At this point, I'd like to talk about the feature.
1. The front and back pockets of the pants are located.
2. Fly with three buttons and a hidden ziper in a convenient location.
3. Staps that can be adjusted, but I'm not sure if they'll work; My pair, however, does not appear to be.
4. Fabric is soft and breathable, with a lovely Victorian pattern.
I was blown away. Okay, let me tell you something— as a trans masc who is short, short wasted, and has big hips/booty, I have a lot to say. dips in the hips, a 29" inseem— I've been battling pants and the way they fit in both gendered standards for about 20 years, and THESE ARE THE BEST FITTING PANTS I'VE EVER HAD ON MY BODY, with no alterations. I'm completely enamored with them and wish they were also available in canvas or solid colors. They're reasonably priced, unlike most Amazon items of this nature that try to overprice. BUY THEM. I get a hot topic vibe from the plastic buttons, but I'm not trying to wear these as a costume, rather as a daily business casual anachronism with high standards, so I'll be altering them slightly in terms of replacing the buttons with antique brass etc. , but I won't be touching the fitting or hemming them. I'm hoping they'll wash up nicely. I'm going to buy everything in every color I can get away with.
Overall, it's a great fit (I usually wear a medium and it's a perfect fit). The only criticism I have is that the pants are lighter than expected, almost more of a charcoal grey/light black color when I was expecting a rich dark sable black color.
The sizes are accurate, and they're a perfect fit! They're great for dancing or any activity that requires movement because the material is stretchy. You'll want to wear them around the house because they're so comfortable!.

I was on the fence about ordering these, but I'm so glad I did. They fit perfectly, have a fantastic pattern, are extremely comfortable, and even have a slimming effect on the midsection. They're a little long for me, but I'm 5'4 so that's to be expected. Because all of the extra fabric is at the ankles, I'll just wear them with boots until I can get them hemmed.
It's breathtaking. The pants have a lovely design and texture to them. The embroidery on the waist and pockets adds a lot of interest, and the buttons are stunning. I'm a huge fan of theirs in every way. They're a great fit for any occasion, stretch well, and are extremely comfortable. 10/10.
First and foremost, I am 6 feet tall and weigh 200 pounds, but I wear a 34x32 jean. I was worried that the legs would be too long, but they fit perfectly. These pants are fantastic! I'd say they're a little snug, so if you're 32-34, go for a large. For anyone with a waist measurement of 34 inches or more, size XL is recommended.
